The legislation that would authorize construction of the keystone pipeline, set to run from Canada to the Gulf of Mexico, failed to pass in the U.S. Senate on Tuesday.
the project has been tied up for six years due to politics, environmental reviews, and objections over where it would be built.
The vote was 59 to 41. The bill needed 60 votes to pass.
Now, the decision on whether to approve the pipeline is in the hands of the State Department.
President Obama has said repeatedly in recent days that he wants congress to stay out of it, and leave it to the department to finish its review of whether the pipeline would contribute to carbon pollution, that could cause climate change.
