Update: In an emailed statement, Secretary of State Jon Husted said he would appeal the court's ruling, saying, "“Whether we vote 35 or 28 days, by mail or in person this November, elected officials and not federal judges should be making Ohio law.”

The Sixth U.S. Circuit Court of Appeals upheld an earlier ruling that told the state it must allow more early, in person voting opportunities. The three-judge appeals court panel’s decision now allows more an extra week of in person voting. And the state has been ordered to provide more weekend and evening voting hours. The question now is whether the state will appeal the ruling. It could ask the full appellate court or the U.S. Supreme Court to rule on the case.
