Trial Delayed for Chardon High School Shooting Suspect T.J. Lane

Attorneys for the prosecution and defense filed a joint motion last week saying they need more time to examine new evidence for the trial that had been scheduled to start next week. Summarizing the motion, Judge David Fuhry said that evidence was apparently “substantial” and “voluminous.”

Geauga County Prosecutor James Flaiz says going through that evidence could take weeks.

FLAIZ: “The defense wants their expert to have time to examine the evidence, and since we don’t, since we’re still awaiting the final forensic analysis, I’m not sure when we will have the evidence to the defense. I expect that to be within the next two weeks.”

Flaiz wouldn’t say what specifically that evidence is. Lane’s attorneys did not return a request for comment, and have generally declined to speak on the record with reporters.

Judge Fuhry said in court that, because of the delay, he would release the current jury pool and send out requests for a new one. Later this month, the judge will set a new trial date. The prosecution has until the end of the month to respond to a defense motion requesting a change of venue.
